Welcome to Mossdew. This website, its content, and its related shopping and customer-support services are operated by Pure Foem INC (“Mossdew,” “we,” “us,” or “our”).

These Terms of Service (“Terms”) govern your access to and use of our website and your purchase of kitchen and household products from Mossdew. Our Privacy Policy, Shipping Policy, Return and Refund Policy, and any other policies posted on the website are incorporated into these Terms by reference.

By accessing our website, creating an account, or placing an order, you acknowledge that you have read and agree to these Terms. If you do not agree, please do not use our website.

1. Eligibility and Account Responsibilities

You must be at least the age of legal majority in your jurisdiction or have permission from a parent or legal guardian to use this website and place an order.

When creating an account or completing a purchase, you agree to provide accurate, complete, and current information, including your:

  • Billing and shipping addresses.

Mossdew offers kitchen tools, food-preparation products, dining accessories, storage products, and other household essentials.

  • Product colors may appear differently depending on your screen or device.

  • Minor differences in dimensions may result from manual measurement.

  • Products and quantities may be discontinued, limited, or unavailable.

You should review all product descriptions, warnings, materials, dimensions, and care instructions before purchasing or using an item.

If an error materially affects an order that you have already placed, we will notify you and provide an appropriate option, which may include confirming the corrected information or canceling the affected item for a refund.

4. Orders and Order Acceptance

Submitting an order constitutes an offer to purchase the selected products. An automated order-confirmation email acknowledges receipt of your order but does not necessarily mean that the order has been accepted.

An order is generally accepted when we send a dispatch confirmation or otherwise confirm fulfillment. We may decline or cancel an order before acceptance for reasons including:

  • Product unavailability.

  • Incorrect pricing or product information.

  • Payment authorization failure.

  • Suspected fraud or unauthorized activity.

  • Shipping restrictions.

  • An incomplete or invalid delivery address.

5. Prices, Taxes, and Payment

Unless otherwise indicated, prices are displayed in U.S. dollars. Applicable taxes, shipping charges, discounts, and other required charges will be shown during checkout.

6. Promotional Codes and Offers

Promotional codes must be entered during checkout and successfully applied before payment is completed.

Unless otherwise stated:

  • Promotional codes cannot be exchanged for cash.

  • Codes may be subject to expiration dates, product exclusions, minimum-order requirements, or usage limits.

  • Multiple codes may not be combined.

  • Codes may not be reproduced, sold, transferred, or used fraudulently.

  • Discounts generally cannot be added retroactively after an order has been completed.

We may cancel or reject a promotional code that is expired, unauthorized, fraudulent, or used in violation of its stated conditions.

7. Shipping and Delivery

Orders are subject to our separate Shipping Policy. Unless different terms are displayed during checkout:

  • Order processing generally takes approximately 3 business days.

  • Delivery after dispatch generally takes approximately 10–20 business days.

  • Eligible orders are subject to a flat shipping charge of $5.99 USD.

Processing and delivery times are estimates unless we expressly identify a date as guaranteed.

If we cannot ship within the stated timeframe, we will provide notice and any options required by applicable law, which may include accepting a revised shipment date or canceling the unshipped order for a refund.

Title and risk of loss generally pass to the customer upon delivery to the shipping address, subject to applicable law and any mandatory consumer protections.

8. Order Changes and Cancellations

Requests to cancel an order, modify an item, or correct a shipping address should be submitted within 12 hours after the order is placed.

Send requests to support@mossdew.com and include your order number, account email, and requested changes.

We will make reasonable efforts to process the request, but changes or cancellations cannot be guaranteed after warehouse processing or shipment has begun.

9. Returns, Refunds, and Product Issues

Returns and refunds are governed by the Return and Refund Policy posted on our website.

If a product arrives damaged, defective, incorrect, or incomplete, contact support@mossdew.com and provide:

  • Your order number.

  • A description of the issue.

  • Clear photographs or video of the product.

  • Photographs of the shipping label and packaging where relevant.

Nothing in these Terms limits a refund, replacement, warranty, cancellation, or other consumer right that cannot legally be excluded.

10. Product Use and Safety

Kitchen and household products must be used only for their intended purposes and in accordance with all product labels, warnings, and care instructions.

Before using a product, you are responsible for confirming whether it is suitable for:

  • Dishwashers, microwaves, ovens, stovetops, or freezers.

  • Contact with food or beverages.

  • Exposure to heat, cold, moisture, or cleaning chemicals.

  • Use by children or individuals requiring supervision.

  • Commercial or professional use.

Do not use a product that appears damaged, cracked, unstable, or unsafe. Exercise appropriate caution when using sharp, heated, breakable, electrical, or food-contact products.

These instructions do not exclude or reduce any responsibility imposed on Mossdew by applicable product-safety or consumer-protection law.

11. Intellectual Property

The website and its contents—including brand names, logos, product photographs, graphics, videos, text, page designs, databases, and software—are owned by or licensed to Pure Foem INC and are protected by applicable intellectual-property laws.

We grant you a limited, revocable, non-exclusive, and non-transferable license to access and use the website for lawful personal shopping purposes.

Without prior written permission, you may not:

  • Copy, reproduce, republish, sell, or commercially exploit website content.

  • Use Mossdew trademarks, branding, or product images in a misleading manner.

  • Mirror, frame, or reproduce substantial portions of the website.

18. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS DIGITAL CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

TO THE FULLEST EXTENT PERMITTED BY LAW, PURE FOEM INC AND ITS OFFICERS, EMPLOYEES, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF THE WEBSITE.

WHERE LIABILITY MAY LAWFULLY BE LIMITED, OUR AGGREGATE LIABILITY FOR A CLAIM RELATING TO A PARTICULAR ORDER WILL NOT EXCEED THE AMOUNT PAID FOR THE PRODUCTS GIVING RISE TO THAT CLAIM.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, legally established product liability, or any other liability that cannot be excluded under applicable law.

Some jurisdictions do not permit certain warranty exclusions or liability limitations, so portions of this section may not apply to you.

20. Indemnification

To the extent permitted by law, you agree to indemnify Pure Foem INC against third-party claims, losses, and reasonable expenses arising directly from:

This obligation does not apply to losses caused by Pure Foem INC or where indemnification is prohibited by consumer-protection law.

These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict-of-law principles.

Before initiating formal proceedings, you and Pure Foem INC agree to make a good-faith effort to resolve the dispute by contacting the other party and allowing a reasonable opportunity for a response.

Subject to mandatory consumer rights and any law permitting proceedings elsewhere, disputes relating to these Terms or the website may be brought in a state court with jurisdiction in Pueblo County, Colorado, or the United States District Court for the District of Colorado.

Consumers may also have rights under the mandatory laws of their place of residence. Nothing in these Terms deprives a consumer of protections that cannot legally be waived.

24. Severability, Waiver, and Assignment

If any provision of these Terms is found invalid or unenforceable, it will be enforced to the maximum lawful extent or severed, while the remaining provisions remain effective.

Our failure to enforce a provision does not waive our right to enforce it later.

You may not transfer your rights or obligations under these Terms without our written consent. We may assign these Terms as part of a merger, restructuring, sale of assets, or other lawful business transfer, provided that doing so does not reduce mandatory consumer rights.

25. Entire Agreement

These Terms and the policies incorporated by reference constitute the entire agreement between you and Pure Foem INC concerning your use of the website and purchases from Mossdew.

They supersede prior communications concerning the same subject but do not override product-specific terms, express warranties, or rights that cannot legally be excluded.
